Utah Scooter & E-Bike Accident Lawyer
Table of Contents
A Utah scooter and e-bike accident attorney can help determine who may be responsible for your crash and what you claim may be worth. If a driver hit you, a rental scooter failed under you, or a dangerous stretch of road put you on the ground, you may have a claim.
These cases get messy fast. The driver’s insurance company may call and ask for a recorded statement. Somebody will bring up the helmet. If you were on a rental, there’s an app agreement you tapped through in two seconds, and it may say more than you’d expect.
Insurers may use all of this when evaluating and defending a claim, often before you have even finished physical therapy. Cockayne Law handles scooter & e-bike accidents across Utah.
If you have been hurt, call before you give a statement or sign anything. The consultation is free.

What Should You Do if You Were Injured in a Scooter or E-Bike Accident in Utah?
- See a doctor, report the crash, and contact a lawyer promptly before you give any statement to an insurance company.
- Go to the doctor even if you feel okay. Soreness and headache often show up a day or two later, and if you wait a week to get seen, the adjuster will say you couldn’t have been that hurt. Mention every ache, even the small ones, so it is in your records.
- Then call the police if they have not come, and get the report number. Take photos of the scene, your injuries, and the scooter or bike, bent wheel and all.
- Don’t get it fixed yet. If you were on a rental, screenshot your ride receipt now, because apps clear out old trips.
- If an adjuster calls, you can tell them you are not ready to talk. You don’t have to give a recorded statement. Call us first, and we’ll handle it from there.
What Scooter and E-Bike Accident Cases Does Cockayne Law Handle?
We take cases from riders hurt on electronic scooters, e-bikes, and similar devices anywhere in Utah. Most fall into one of four groups.
Car, Truck, and Hit-and-Run Collisions
Most of the cases we see start with a driver who didn’t look and turned across a rider’s path or opened a door into one. If the driver left the scene, we’ll still look for coverage through your own policy. See our hit-and-run accident attorney in Utah page for more.
Rental Scooter Accidents
Riders on a shared scooter get hurt when the brake fails, a wheel catches a crack, or the device is poorly maintained. The rental company’s user agreement may limit your rights, so read it before you assume it ends your claim.
Defective E-Bike and Scooter Accidents
Sometimes the problem is the product. Brakes that give out, frames that snap, and batteries that overheat can all cause serious injuries, and the manufacturer or seller may be responsible.
Road and Pathway Hazards
Potholes, broken pavement, loose gravel, and poorly marked bike lanes can throw a rider off fast. If a city, a county, or a property owner lets a hazard sit, they may be responsible. Claims against government entities have strict notice rules, so don’t wait.
Who Is Liable for a Utah Scooter or E-Bike Accident?
It depends on who caused the accident. Sometimes a single person is responsible, or sometimes more than one party is responsible for fault. A brake that gave out is one case. A driver who cut you off is another. So is a pothole the city never fixed.
Negligent Drivers
These types of crashes mostly occur due to drivers’ mistakes. They turn left across a rider’s path, swing a car door open into the bike lane, or pull out of a driveway without checking. A scooter is easy to miss, but that doesn’t excuse the driver. We start with their liability insurance. If they drove off or had no insurance, your own UM coverage may pay instead.
Scooter and E-Bike Rental Companies
If the scooter was rented, the handlebar was loose, the brakes were worn, or the battery died mid-ride, the company may also be responsible for the crash and may share the blame. The catch is the app.
You probably tapped “I agree” on terms that include a waiver. That doesn’t kill your claim, but it makes things harder. Take a screenshot of those terms and your trip receipt now before the app changes.
Manufacturers and Distributors
Sometimes the scooter itself was built wrong. For example, the throttle stuck, a frame cracked, or the battery caught fire. If that’s what happened, the maker or the seller may be responsible. You don’t need to fix it or throw it out, because those broken parts are often the best proof you’ll have.
Property Owners and Government Entities
A hazard on the ground can throw a rider off just as easily as a careless driver. Think of a broken sidewalk edge, a pothole, or a dark path covered in debris. Whoever controls that spot may be liable, whether that’s a private owner or a city, county, or state agency.
Claims involving a Utah government entity may require a formal written notice of claim within a much shorter period than an ordinary personal injury lawsuit. A one-year notice deadline generally applies to many such claims, but the applicable rules depend on the circumstances.
Speak with a Utah personal injury attorney promptly if a public road, pathway, or government-owned property may have contributed to your accident.
What Compensation Can You Recover After a Scooter or E-Bike Accident?
The money you can claim falls into two groups: the bills and losses you can add up and the harm that doesn’t come into receipt. Here’s what usually goes into a claim.
- Medical Bills: The ambulance, surgery, ER visit, hospital stay, prescriptions, and physical therapy. It also covers care you’ll still need later, like follow-up surgery or months of rehab.
- Lost Income: The paychecks you missed while recovering. If the injury means you can’t do the same work anymore, you can claim the drop in what you’ll earn down the road too.
- Pain and Suffering: These are the abstract things like trouble sleeping, pain itself, and things you can’t do the way you used to. If a car hit you, Utah makes you clear a hurdle before you can ask for pain and suffering. A broken bone gets you there, and so do medical bills over $3,000. So does anything lasting, like permanent disfigurement, or a permanent disability or impairment your doctors can back up with objective findings. Dismemberment and death count too. Not every claim runs this way, though. Uninsured motorist claims work differently, and a scooter or e-bike crash doesn’t always fit the rule neatly, so it’s worth asking a lawyer before you assume you’re in or out.
- Emotional Distress: After a bad crash, many people are plagued by fear of getting back on a scooter, anxiety, and depression. It’s real harm; a doctor’s or therapist’s records help show it.
- Property Damage: This can cover your helmet, phone, clothing, or bike. Take photos before you repair or throw anything out.
- Out-of-Pocket Cost: Rides to doctor appointments, medical equipment, or changes to your home if you can’t get around the way you did before.
- Wrongful Death: If a rider dies in a crash, their family may be able to bring a claim of their own.
What you actually get collected depends on who is paying. A driver’s insurance only goes up to its limits, and if you were partly at fault, your payment drops your share. We look for every source of payment that fits your crash.

What Insurance Covers a Scooter or E-Bike Accident in Utah?
Scooters and e-bikes usually have no insurance of their own, so the money for your claim often comes from somewhere else. Our team tracks down every policy that could pay, so you’re not guessing.
The At-Fault Driver’s Insurance and Other Applicable Coverage
If a driver hit you, we go after their liability insurance first. Utah’s minimum is only $30,000 for one person’s injuries, and a serious crash can use that up fast.
So we look for a household policy, if applicable; a business policy if the driver was working; and any of your own coverage that applies, including health insurance, medical payments, PIP, or an umbrella policy.
Uninsured and Underinsured Motorist Coverage
If the driver is uninsured or has no insurance, we check whether your UM coverage can step in. If the driver had too little underinsured motorist coverage, it may cover part of the gap.
We also handle notice requirements, so a missed deadline doesn’t put your claim at risk.
Rental Company and Other Insurance Policies
Riding the rental? We review terms and the company’s coverage before anyone tells you what you can or cannot claim. If a defective scooter or a dangerous road caused the crash, we also look at the manufacturer and the property owner’s insurance.
Call us before you talk to any insurer or give a recorded statement. It’s completely free to consult.
What Are the Utah E-Bike and Electric Scooter Laws?
Utah counts most e-bikes as bicycles. That means you can ride on the road, but you also have to follow the same traffic rules as any other cyclist. After a crash, an insurer will look at both.
The law sorts e-bikes by how fast the motor takes you:
- Class 1: Pedal assist only, tops out at 20 mph.
- Class 2: Has a throttle so it can go without pedaling up to 20 mph.
- Class 3: Pedal assist only, tops out at 28 mph.
All three motors have a motor of 750 watts or less. Electric scooters are treated differently, and anything faster or stronger than these limits can be classed as a moped or motorcycle.
That changes the licensing or insurance rules, and it can change which coverage applies to your claim.
Riding against traffic or without lights at night doesn’t end your claim. It only matters if it helped cause the crash, and even then it’s one factor in how fault gets divided, not an automatic bar. Utah’s comparative fault rules decide how much your own conduct counts against you.
Helmets are a separate question. Under Utah law, not wearing a helmet that a helmet statute covers can’t be held against you as comparative negligence, so an insurer shouldn’t be able to use it to cut your recovery.
How Does Cockayne Law Handle Scooter and E-Bike Accident Claims?
We start with a free conversation about what happened, what you were riding, and how badly you were hurt. Then we get to work before the evidence goes away. We send preservation requests for camera footage, save the rental app’s records, and keep the damaged scooter or bike as it is.
Next, we find out who is responsible and which policies could pay, whether that’s a driver, a rental company, a manufacturer, or a city. We deal with the insurance adjusters so you don’t have to give a recorded statement.
Once your treatment is clear, we put together your medical records, bills, and lost wages and send a demand. If the insurer won’t offer a fair amount, we are ready to file a lawsuit. You decide whether to settle and don’t push yourself to take an offer while you are still recovering.
FAQs
Yes, you may still recover compensation if you were partly at fault. Under Utah’s comparative fault law, your recovery generally depends on whether the fault attributed to the other responsible parties exceeds your own. Any recovery may be reduced according to your share of fault. The facts of the crash and how fault is allocated can affect the outcome.
You can still bring a claim. If the brakes were worn or the handlebar was loose, that’s on the rental company. If a driver hit you, that’s on the driver. Yes, you agreed to the app’s terms, and they may include a waiver. That makes your case harder, but it doesn’t kill it. Screenshot those terms and receipt today.
Not for the scooter or bike itself. Most car policies leave out anything with fewer than four wheels. Your injuries are another story. If a car hit you, your medical payments, PIP, or UM might apply depending on how your policy is worded.
Call the police and get a report number before you do anything else. Then think about who or what might have seen the driver: a store camera, a bystander, a piece of the plate, a flake of paint on your frame. If nobody ever finds the driver, your own uninsured motorist coverage may still pay. Don’t put this off, because a lot of cameras tape over their footage within a few days.
Yes, if a frame snapped or a battery caught fire, the company that made it or sold it may have to answer for that, whether the flaw was in the design or the way it was built or a warning that never made it onto the label. Don’t fix the scooter or bike. That part that failed is usually the best proof you have.

You were riding on a vehicle with no airbags, no frame around you, and nothing between you and the pavement. Now there are medical bills, an adjuster who keeps calling, and questions about who is actually responsible.
You don’t have to sort this out alone. Tell us what happened, and we’ll look at who may be at fault, which policies could pay, and what your claim may be worth.
The first conversation is free, and you owe us nothing unless we recover money for you. Call Cockayne Law or send a message through the form.

Karen was great to work with. She’s done three cases for me and I couldn’t be happier. She’s gotten me well compensated when I thought I wasn’t gonna get too much of anything. I really appreciate the work they did especially when they took care of her car appraisal for me where the appraisal came in at half of what they actually paid me which is actually double and some what I paid for my car.
