UTA Bus Accident Claims 

A claim against UTA or another government entity is governed by the Utah Governmental Immunity Act. You can’t simply file a lawsuit. A little notice of claim must come first, and for most claims, that notice must be filed within one year after the claim arises.

The governmental entity then has 60 days to notify you that it received the notice. You generally cannot file a lawsuit until that 60-day period has passed. The notice deadline and the lawsuit deadlines are different. 

Under Utah law, a claimant generally must commence the action within two years after the claim arises, subject to the statute’s specific rules and expectations. Utah also limits damages that can be recovered from a governmental entity, and punitive damages generally are not available.

Missing the required notice deadline can bar the claim entirely, so a government bus accident claim should be addressed as soon as possible. 

What to Do After a Bus Accident in Utah 

Witnesses leave fast after a bus crash. Passengers step off and walk away, and the bus may be back on its route before you finish with police. If you can, do this before you leave the scene.

  • Call 911 and ask for a police report, even if the crash seems minor. 
  • Write down the bus number, route, and the driver’s name, and photograph the bus from several angles if you can do so safely. 
  • Get the phone number from anyone who was on board or saw it happen.
  • Photos of the bus, the road, and your injuries. 
  • Seek medical attention promptly, especially if you have pain, dizziness, head or neck symptoms, or other signs of injury.
  • Don’t sign anything the bus company or agency gives you, and skip the recorded statement.

Yes, if someone’s mistakes caused the crash. You don’t have to have been driving to bring a claim. If the bus belongs to UTA or another government agency, you can’t go straight to court. There’s a notice process first.
