How a Utah Head-On Collision Lawyer Can Help With Your Case
After a head-on crash, fault is often the main point of dispute. Each driver may say the other crossed the center line, and without a clear witness, the case can come down to what the physical evidence shows.
Investigation:
Investigate how the accident happened. A police report is often a useful starting point, but it may not tell the whole story. A lawyer reviews the scene, road layout, photos, and witness statements.
If the facts are contested, an accident reconstruction expert can help explain how the vehicles ended up where they did.
Preservation:
We work to preserve relevant evidence, including vehicle data and available scene documentation. A damaged vehicle can be repaired or sold for parts, and the skid marks can also wash away. Many newer vehicles also store speed and braking data from just before impact, so writing a request to preserve a vehicle should go out early.
Establishing Fault & Dispute Liability:
When the driver blames you, we look at lane position, point of impact, speed, and anything that shows what that driver was doing at the time of the crash.
Settlement Negotiations:
We handle insurance companies and settlement negotiations. An insurer may request a recorded statement before the full extent of your injuries is known. We communicate with insurers for you to negotiate once your treatment gives a clear picture.
Calculated Losses:
We calculate your current and future accident-related losses. Serious injuries can lead to ongoing care and time away from work. We review your medical records and, if needed, input from doctors to estimate what the claim should be.
Preparing Your Case for Trial When Necessary. Not every case settles. If an insurer will not make a fair offer, we are prepared to take the claim to court.

What Causes Head-On Collisions in Utah?
Almost every head-on crash comes down to one car ending up where it shouldn’t be. How it got there matters, because that is usually what the claim rests on.
- Drivers crossing the center line. It can be a glance away from the road or a swerve around a deer on a canyon road. Either way, the other driver has no time to get out of the way.
- Distracted or impaired driving. Phones are the usual culprit. Alcohol and drugs are the other, since they slow reactions and make lane control worse.
- Speeding and losing control. Take a wet curve or patch of ice at the wrong speed, and the car can slide across the line before the driver does anything about it.
- Unsafe passing. On a two-lane highway. One bad pass can put a car straight into oncoming traffic.
- Drowsy driving. Tired drivers drift, and they often don’t brake because they never saw it coming.
- Wrong-way driving. On a highway, other drivers get a few seconds at most to react.
- When a driver breaks a traffic law or fails to use responsible care, that may support a claim for the injuries that follow.
Common Injuries in Utah Head-On Collisions
A head-on collision at highway speed can end up with severe injuries even if the driver wears the belt too. These injuries differ a lot from one seat to the next.
- Traumatic Brain Injuries
- Broken Bones and Fractures
- Spinal Cord Injuries
- Organ damage and internal bleeding
- Severe lacerations and burns
- Fatal injuries and wrongful death
These injuries can have a serious impact on many parts of your life, from your ability to work to the quality of your life. A head-on collision attorney can help you understand how your injuries may affect your claim.
Who Is at Fault in a Utah Head-On Collision?
It usually comes down to one question: which car was over the line when they hit? Sometimes that is obvious. Often it is not, because both drivers come away with different stories.
- Proving the other driver crossed into your lane. Investigators start by pinning down where the impact happened. Gouges in the pavement, the path of the debris, and the damage on each car say a lot. So do the lane markings and any curves in the road.
- Police reports, witness statements, and crash reconstruction. Most officers arrive after the crash is over, so the report is their best reconstruction, not an eyewitness account. Statements from people who weren’t in either car tend to help the most. When the stories still clash, a reconstruction expert can work backward from the wreckage.
- Dashcam footage and vehicle data. One clip from a dashcam or a nearby business camera can settle an argument. Some cars also record their speed and braking in the seconds before impact, so it’s worth asking for that data early.
- When both drivers share fault. Utah follows a modified comparative-fault rule. You may recover damages if your fault is less than the combined fault of the defendants and other parties whose fault is included under the law. Your recovery may be reduced based on your share of fault. If your fault meets or exceeds the applicable threshold, you may be barred from recovering damages.
If the other driver says it was you. Plenty of drivers do, and adjusters often repeat it. What decides the question is the evidence, not who said it first.
What Compensation Can You Pursue After a Head-On Collision in Utah?
Compensation is meant to cover what the crash cost you, including the bills you can add up and the harm that is harder to measure. What you can actually recover depends on the evidence, how serious your injuries are, who was at fault, and how much compensation is available. No lawyer can promise a number.
- Medical bills include emergency treatment, ambulance transport, ER visits, surgery, and any time you spend in the hospital.
- Your future medical bills if your injuries are severe, rehabilitation, and therapy. Follow-up surgeries, physical therapy, medication, and ongoing care if the injury never fully heals.
- Lost wages and reduced earning capacity. The pay you miss while you recover, and the income you may lose later if you can’t go back to the same work.
- Pain, suffering, and loss of enjoyment of life. The physical pain plus the things you can no longer do the way you used to.
- Vehicle damage and other financial losses. Repair or replacement of your car, along with out-of-pocket costs that came from the crash.
- Compensation for families after a fatal collision. Surviving family members may be able to pursue funeral and burial costs, lost financial support, and the loss of the loved one’s companionship.

What to Do After a Head-On Collision in Utah
Call 911 and get looked at by a medical professional, even if you feel okay. Concussions and internal bleeding can take hours to show up, so don’t trust how you feel at the scene. Leave the car as it is until a lawyer has seen it.
- Call 911 and ask for police and an ambulance. Before you leave, get the police report number.
- If you can move without pain, get out of traffic. A sore neck or back means stay where you are.
- Photograph both cars, the center line, any skid marks, and whatever injuries you can see. If anyone stopped to help or saw it happen, get their name and number.
- Don’t have the car repaired or sold for scrap. Many newer cars record speed and braking just before impact, and the damage shows where the two cars met.
- If the other driver’s insurance company calls, you don’t have to give a recorded statement. Offers sometimes arrive before anyone knows what your treatment will cost, so hold off on accepting one.
- Call a lawyer soon. Camera footage gets taped over and vehicle data gets lost, and a request to preserve it only helps if it goes out early.
Hold on to your medical records, the accident report, any letters from insurers, and your photos.
How Utah Car Insurance Rules Affect a Head-On Collision Claim
After a head-on collision in Utah, two insurance questions get answered at two different times. The first one is paying right now, and the second is the one who ends up responsible for everything the crash costs you.
Utah no-fault rules keep both questions apart; the people who treat them as one are often caught off guard by how their claims unfold.
Who Pays First: Your own PIP coverage. Every Utah policy includes personal injury protection. It covers medical bills and some other losses no matter who caused the crash, but the required minimum is just $3,000 per person. For a head-on collision injury, that can be gone after the ambulance ride and the first scans.
Who Pays in the End: Utah law limits when an injured person covered by PIP may pursue general damages, such as pain and suffering, against another driver. The statutory conditions include death, dismemberment, permanent disability or impairment supported by objective findings, permanent disfigurement, a bone fracture, or medical expenses exceeding $3,000. Different rules may apply to uninsured-motorist claims. Whether a particular claim qualifies depends on the facts and applicable law.
When the Other Driver Has No Insurance: In that situation, your uninsured motorist coverage may provide compensation, subject to the policy terms, applicable law, and coverage limits.
When Their Policy Is Too Small: Your own underinsured motorist coverage on your policy may fill the gap up to your policy limits.
Multiple Policies Are Involved: Your insurer, their insurer, and sometimes other policies in your household can all play. Which one pays first and how they offset each other depends on the policy wording and Utah law. Get someone to read it before you sign any settlement.
How Long Do You Have to File a Head-On Collision Claim in Utah?
In Utah, you have 4 years to file a personal injury claim from the date of the head-on collision. But this is not for all types of claims. For example, if someone died, the family has 2 years from the date of death.
Besides, if a case involves government property, an agency, or a vehicle, you may need to file a claim within one year. Evidence rarely lasts as long as the deadline does, so it’s worth acting well before it gets close.

FAQs
You may still be able to go after their estate. A claim may still be possible against the deceased driver’s estate or applicable insurance coverage, depending on the circumstances.
Yes. You didn’t cause the crash, so you may have a claim against the driver who did. If the driver you were riding with was also partly to blame, their insurance could be involved as well. Which policies apply is worth sorting out early.
Possibly. These claims tend to involve more parties than a typical crash. If the driver was on the job, the employer may share responsibility, and so may the vehicle’s owner. Driver logs and maintenance records can matter, but they can disappear, so ask a lawyer to request them early.
A lot of drivers say this, and it is not an automatic defense. What matters is whether the swerve was a reasonable reaction to a real emergency or whether the driver helped create the emergency by following too closely or going too fast. Witnesses and any video usually matter most here.
Think hard before you take it. Early offers tend to show up while you’re still treating, before anyone knows if you’ll need surgery or months of therapy. Once you sign a release, you generally can’t ask for more later, even if your injuries turn out worse than expected.

Karen was great to work with. She’s done three cases for me and I couldn’t be happier. She’s gotten me well compensated when I thought I wasn’t gonna get too much of anything. I really appreciate the work they did especially when they took care of her car appraisal for me where the appraisal came in at half of what they actually paid me which is actually double and some what I paid for my car.
