A rear-end crash takes about a second. One moment you’re stopped at a light on State Street or creeping along I-15, and the next you’re sitting in a car that’s been shoved forward. The bills and the sore neck come after that. So do the missed shifts and the insurance adjuster who keeps calling. Cockayne Law represents Utah drivers and passengers who were hurt in rear-end collisions. Call us for a free consultation. We’ll go over what happened and talk through what you can do next.

Why Hire a Utah Rear-End Collision Lawyer?

Many people assume rear-end collision claims are straightforward. The car in back hit you, so its insurer pays. It does not always go that smoothly. Insurers still push back on who was at fault, how badly you were hurt, and whether the crash caused the injury at all.

Investigating How the Collision Happened

The police report and your photos help, but they are the easy part. Traffic and business cameras record over footage on a schedule, sometimes within days, so we send a preservation request early. If the facts point to a distracted driver, we look into phone use too.

Handling Insurance Companies

The other driver’s insurer will call, often within a day or two, and be very polite. They’ll ask for a recorded statement. They may offer a thousand dollars on the spot. Take it, and you probably close the claim, even if an MRI next month shows a herniated disc.

You may wish to consult an attorney before giving the other driver’s insurer a recorded statement or discussing a settlement.

Evaluating the Full Extent of Your Losses

Week one of a whiplash diagnosis tells you very little. Some people are fine in a month. Others spend half a year in physical therapy, and a few end up needing injections or surgery. We don’t put a number on your claim until your doctor has a clear idea of where treatment is going. Then we add it all up: the medical bills, the paychecks you missed, and the things you can’t do at home anymore. That total is where negotiations start.

Who Is at Fault in a Rear-End Collision in Utah?

If you were hit from behind, the other driver is usually the one to blame. Utah requires drivers to leave enough room to stop, so a car that slams into one that’s already stopped is in a tough spot. Insurers will still try to pin part of it on you, maybe by saying you braked too hard. That’s why we start collecting evidence for your side right away.

Common Causes of Rear-End Collisions

Common causes include:

  • Texting or other phone use behind the wheel
  • Tailgating
  • Speeding in stop-and-go traffic
  • Snow and ice on I-15 and along the Wasatch Front

Another motorist who cut off the bus or ran a light can be at fault too. When it belongs to UTA or a school district, a government entity is involved, which changes the deadline and the way a claim has to be filed.

What If the Other Driver Says You Caused the Crash?

Some drivers claim you braked suddenly, had a brake light out, or pulled in front of them. Don’t argue at the scene. Photograph the vehicle and the road, get contact details from any witnesses, and call us before you give a statement. We’ll gather the evidence that shows what actually happened.

Common Injuries in Rear-End Collisions

Rear-end collisions can cause head, neck, and back injuries. Some symptoms may not appear immediately, and injured people may not initially connect them to the crash

Whiplash and Neck Injuries

The neck gets thrown back and then forward, and the muscles and the ligaments take the strain. Stiffness and headache are common. Many people feel okay on the spot and wake the next day unable to turn their head.

Back, Disc and Spinal Injuries

Herniated discs happen. Numbness in your fingers or a shooting pain down your leg can mean a nerve is involved, which ordinary soreness doesn’t cause. Ask your doctor whether imaging makes sense.

Head Injuries and Concussions

No impact to the head is needed. The brain can still move inside the skull during the crash. Brain fog, trouble concentrating, and sensitivity to light are what we hear about most.

Serious or Delayed-Onset Symptoms

Pain can take days to appear because adrenaline covers it up at first. See a doctor now, even if you feel okay. If the symptoms get worse, go back. Those visits also create a record that shows when your symptoms started.

Utah Insurance Rules After a Rear-End Collision

Utah is a no-fault insurance state. It means your own personal injury insurance pays first, even if the other person is at fault. That surprised lots of people. It also shapes when you can go after the other driver.

How Personal Injury Protection (PIP) Works

PIP is the no-fault coverage on your own policy. It pays medical bills and some lost income no matter who caused the crash, up to your policy limit, and you don’t have to wait on a fault decision. It runs out fast, though. One ER visit and a round of imaging can use up most of it.

When Can You Recover Pain and Suffering Damages After a Utah Rear-End Collision?

Utah’s no-fault insurance rules generally restrict claims for general damages, such as pain and suffering, after a motor vehicle accident unless a statutory exception applies. Qualifying circumstances include medical expenses exceeding $3,000, a bone fracture, dismemberment, permanent disability or impairment based on objective findings, permanent disfigurement, or death.

These rules do not mean that every claim for compensation is barred below the threshold. The type of damages available depends on the circumstances, the applicable law, and the insurance coverage involved. A Utah attorney can review your injuries and explain which claims may be available.

What If the Other Driver Has No Insurance or Insufficient Coverage?

Utah’s minimum liability coverage is $30,000 per person and $65,000 per accident for injuries. A serious injury can blow past that, especially when several people are hurt. If the driver has no insurance or too little, your own uninsured or underinsured motorist coverage may fill the gap. Check your policy, or send it to us and we’ll check it.

What Compensation May Be Available After a Rear-End Crash?

If someone else caused your crash, Utah laws let you seek compensation for what it cost you. That means the bills in your mailbox and the harm that never shows up on a bill. What you can actually recover depends on your injuries and the facts of your case.

Medical Expenses and Future Treatment

Ambulance ride, ER visit, months of physical therapy. All of it counts. So does treatment you haven’t had yet. If your doctor says you’ll probably need injections and surgery later, that belongs in the claim before your settlement, because a settlement closes the door on asking for more.

Lost Wages and Loss of Earning Capacity

Missed paychecks are an obvious part, and so are the vacation and sick days you burned through. The harder question is what happens if you can’t do your job the way you used to. A mechanic who can’t lift or an office worker who can’t sit through a full shift may lose years of income, and we factor that in.

Pain, Suffering, and Other Recoverable Damages

Constant pain, bad sleep, skipping your kids’ games, and giving up the gym. Utah lets you seek compensation for that. If you have not come up with receipts, we build the case from medical records, a pain journal if you keep one, and what your family and coworkers have noticed.

What Affects the Value of a Rear-End Collision Claim?

The duration and how severe your injury is also matter. Other factors include your share of fault, how much insurance is available, and how well your records hold up. If someone quotes a number before looking at any of that, don’t trust it.

How Cockayne Law Can Help With Your Rear-End Collision Claim

Right now, your job is to heal. Our job is to deal with the insurance company, the paperwork, and the deadline.

Case Review and Investigation

First of all, we talk to you calmly. You can tell us freely what happened, how you are feeling, and what treatment you have had so far. Then we get to work on the police report, photos, medical reports, and any video of the crash. We also find out who was at fault and what insurance is actually available.

Building a Documented Claim

Insurers pay attention to paper. We gather your medical records, doctors’ notes, pay stubs, and records of the time off work so the claim shows everything you have been through and not just the ER visit.

Negotiation and Litigation

Most cases are without a trial, and we push for a settlement that reflects what the crash cost you. If the insurer disputes liability or refuses to offer a reasonable settlement, litigation may be an option.

Communication and Guidance Throughout Your Case

We will keep you updated, and you can ask us questions along the way. Injury claims move slowly, and not knowing what is happening is hard on people. We would rather you hear it from us.

What to Do After Being Rear-Ended in Utah

  • Call 911 and get a police report number. You must inform the police even if it’s a minor crash.
  • If you feel okay and have enough power, get out of traffic and turn on your hazards.
  • Don’t forget to take photos of both cars, the plates, the road, and anything on your body that hurts.
  • Note down the driver’s name, phone number, and insurance details, plus contact info for any witnesses.
  • See a doctor the same day or the next, even if you feel perfectly fine.
  • If the other driver’s insurer calls, you don’t have to give a recorded statement.
  • Talk to a lawyer before you sign a release or take a settlement offer.

How Long Do You Have to File a Rear-End Collision Claim in Utah?

In most Utah personal injury cases, you have four years from the date of the injury to file a lawsuit. Some situations can change that timeline, so it’s worth confirming the deadline for your specific case.

Claims involving a government entity work differently. Before you can sue, you generally have to file a written notice of claim within one year after the claim arises. The lawsuit itself then has its own separate requirements and deadline.

Don’t assume the four-year rule applies to you. If a government vehicle or employee may have played a part in your crash, talk to an attorney as soon as you can so you know exactly which deadlines you’re working with.

FAQs

Maybe. A cracked bumper tells you about the car, not about you. Some of the worst neck and back injuries come from low-speed hits, and the pain can start a day or two later. If you’re sore or the other insurer is already giving you a hard time, a free consultation won’t cost you anything.

If the driver was working at the time, the employer may share the responsibility. That can open a larger insurance policy, but it also means more lawyers on the other side. Tell us right away and don’t talk to the company’s insurer.

Yes, you can. Adrenaline hides pain, and plenty of people feel the damage a day or two later. Just see a doctor as soon as you see the symptoms. A long gap gives the insurer an opening that the crash wasn’t the cause.

Bring whatever you have. For example, a police report number, photos, both drivers’ insurance details, medical bills and records, and proof of missed work. Any letters from an insurer help too. Don’t worry if something is missing. We can request it.

Most personal injury firms work on contingency, meaning no fees until you recover. We confirm how fees work, including the percentage and who covers case costs. We’ll explain the terms before you sign anything.

Karen was great to work with. She’s done three cases for me and I couldn’t be happier. She’s gotten me well compensated when I thought I wasn’t gonna get too much of anything. I really appreciate the work they did especially when they took care of her car appraisal for me where the appraisal came in at half of what they actually paid me which is actually double and some what I paid for my car.
